TFF Component of School Materials Awarded to a Private Company - K69 Million

K69 MILLION FOR PROCUREMENT AND DISTRIBUTION OF SCHOOL SUPPLIES IN 2019

How will the National Government meet the cost?

The discussion in base on the above report from PNG Legend FM news online. In fact, since the inception of Tuition Fee Free Education policy, procurement of supplies and distribution of school/student's materials are done by Borneo Pharmaceutical's subsidiary HM Supplies Limited. 

The private company has tried its best to deliver the much-needed supplies to school. Whether its attempts have been successful is not a matter of this discussion. 

The opinion shared here is to find a better way - sustainable way - to coordinate the procurement and distribution of school materials. My work on TFF policy has shown that the best way to coordinate the Learning and Teaching grant is through the education department.

The government should avoid using the intermediaries or subsidiaries to do what the department can do. Fund schools directly. 

Let the education department create strong accountability measures around the use of the grant and police them. The department has the manpower and network capability to do it. Do not underestimate the department.

Perhaps it is important to KNOW that the Education Department has an intricate network of national and provincial officers/divisions/branches/TFF secretariat that it (education department) can use supply school materials effectively.


No need to underestimate the education department network

Using the education department to procure and distribute school supplies is not a new concept. School materials, in the past, was the sole responsibility of the education department.

There is NO need for a private company to oversee the procurement and supply of teachers and students' learning materials. 


TFF 40% Cash Grants Facilitated by Education Department

Every year the National Government budgeted over K600,000,000 to fund the TFF policy.

From 2012 to 2016, an average of K6 million had been allocated annually. Of this 60% is not controlled by the education department. The department only oversees the use of 40% cash admin component.

The 40% cash grant is the most talked about the component on mainstream and social medium. Most often, schools do not receive the grant on time.

In the last 8 years, the 4th quarter does not reach the schools until the beginning of the next year. So, there are many questions surrounding the release of the 40% School Admin component/Grant: 
  • Are schools really getting the 4 (quarterly) instalments each year? 
  • Is the budget allocation realistic?
  • What is the actual amount released to schools?
  • What is/are the transparency measure/s to monitor the distribution (at the Education Department) and use of the TFF 40% cash grant (by schools)
  • Are the data provided by schools reliable?

To make it clear, the education department has done a fantastic job publishing the financial reports of the 40% cash grants. Visit the education department website or make an appointment with the TFF secretariat to get more information.

TFF 30% Infrastructure Development Grant facilitated by MPs and Provincial Treasuries 


Secondly, the infrastructure grant has lots of grey areas as far as accountability is concerned. Understandably, this was a joint-grant initiative of the government where the local Member of Parliament and provincial treasury work with the school board and school administration to improve school infrastructure. 

MPs are obliged to use taxpayers money which they receive through their DSIP/PSIP to lead infrastructure development projects initiated by schools. 

MPs part in realising the TFF policy's dream of school infrastructural development can be hard to track. The main reason is that there is no presence of centralised data/evidence to show the USE of the 30% infrastructure grant under to control of the MPs and provincial treasuries in the country. 

As mentioned, it remains a grey area unless a mandatory investigative review is conducted to ascertain the use of the 30% grant.


TFF 30% Teaching and Learning (T&L) Support Component - Facilitated by a private company


Thirdly, the T&L support grant is awarded to an expatriate private business - Borneo Pacific  Pharmaceuticals - through its subsidiary MH Supplies Limited.

The company tried its best to procure and deliver students and teachers  (learning and teaching) supplies to schools in the last 8 years. 

However, there also many unanswered questions.
  • Is the company procuring and delivering the right materials to schools? 
  • Are the schools receiving the much-needed supplies on time?
  • What is the cost per head?
  • How much is the company receiving and spending?
  • Are the schools happy with what they are receiving?
  • Can the education department do the procuring and distributing of materials?
  • Why is the government not using the well-established network of the education department as the distribution channel?

Wow! Wow! Wow! Last year (2018) schools received their supplies of education materials for 2014. We can only guess that the supplies that were distributed this year to schools were meant for 2015.
This has to be clarified to the nation otherwise some bucks for supplies meant for 2016, 2017 and 2018 are missing. School's basic materials component is probably disappearing from the TFF into thin air this way.
Clarifications needed. Schools through out PNG have received three lots of basic TFF materials. 2013, 2018 and 2019. What happened in between is any body's guess. Ben Berom, PNG Teachers on Facebook, 29/04/2019
Finally, what we know is that the department of education has a reporting mechanism in place where it reports on the 40% Cash Admin grants, titled Administration and Financial report.


The missing data taxpayers must know

The TFF Policy MAY HAVE failed in several ways. One is that there is no evidence of report of the 30% Infrastructure Development grants available in the public domain.

Another financial report that is not available to the public is the administration and financial report for the 30% School Learning and Improvement grant.

So, who are the main players in this TFF policy? It is not the education department. 

The country needs to know, after 8 years, how 60% of the TFF money is spent! We cannot be complacent and hope that all is okay.

When it is about the use of the education Grants, it is every body's business to demand that quality is there and every toea spent on procurement and distribution is accounted. And importantly, the school supplies and infrastructure are delivered.

Furthermore, there is transparency and accountability. Is it too much to ask?

If I have missed something here, I would be glad to be pointed in the right direction. Show me the Administration and Financial Reports of the Infrastructure Development (30%) and the School Learning and Improvement (30%) Grants.

If not, it would only be proper to reiterate the intention of the Minister for Education to conduct an investigative review into the use (and abuse if any) of the TFF funds since 2012. 

This is the right thing to do.

    Rugby League World Cup Tours PNG Kumuls and British Lions

    THE Papua New Guinea Kumuls will compete in two major Rugby League International Federation-sanctioned challenges this year.

    Southern hemisphere general manager Jeremy Edwards was in the country yesterday to present the RLIF calendar highlighting the inaugural Oceania Cup and the British Lions tour, of which the Kumuls will be part.

    Competing in the Oceania Cup are Tonga, Samoa, Fiji, PNG, and co-hosts Australia and New Zealand.

    Australia, New Zealand and Tonga make up pool A while Samoa, Fiji and PNG occupy Pool B.

    Pool A and Pool B will compete for a trophy and shield respectively.

    The last-placed nation in pool A will be demoted to pool B and the first-placed side in pool B will be promoted to pool A.

    “The exciting thing about this is to see the nations play for something that is meaningful and will start every mid-year,” Edwards said.

    The Kumuls' first Oceania Cup fixture is against Samoa in Sydney on June 22 and the second against Fiji in Christchurch, New Zealand, on Nov 9.

    The Kumuls as with similar mid-year Tests is set to feature mostly Australian based talent with players from the Hunters and Q-Cup as well as the NRL to be considered.

    Head coach Michael Marum, pictured, as well as the PNGRFL, are yet to confirm whether players from the UK will be considered for the June international.

    Meanwhile, the Lions tour will be held in New Zealand and PNG, with the Brits playing Tonga on Oct 26, New Zealand on Nov 2 and Nov 9, and the Kumuls in Port Moresby on Nov 16.

    The PNG Orchids (women) will also get an opportunity to play an international test against a Pacific All-Stars side on Nov 16.

    In attendance to witness the launch were New Zealand Rugby League chief executive Greg Peters, PNG Rugby Football League chairman Sandis Tsaka, Immigration and Border Security Minister Petrus Thomas and PNG Sports Foundation chief executive Peter Tsiamalili Jr.

    Tsaka said more international fixtures would improve PNG’s ranking.

    PNG Hunters News Update - Former Players in the UK and Australia

    Update: Further to a post on PNG Hunters former players, this post provides an update on where the 2014 Grand Final winning players' club in the UK and Australia.

    Many players who had the opportunity to move to play overseas have either stayed with the teams they were contracted with or moved around. So, this is the latest on where the original PNG Hunters are mid-2019.

    Featherstone Rovers released Watson Boas on loan to Doncaster RLFC. Watson played 11 games and scored 4 tries. He did not feature in the plays in late April 2019 due to availability of other Rovers halves.

    'The coaching team at Featherstone Rovers will monitor Watson closely and be very much in regular contact with the Doncaster coaching staff and the player'
    The Boas brothers, Watson and Ase, and Thompson Tete joined the second tier club early in 2019. They play several games for the Rovers. 

    Thompson Teteh nursed a suspected shoulder injury.

    Ase returned home due to family reasons. He is now back with the PNG Hunters 2019.

    Watson is now playing for the Doncaster RLFC with two other Papua New Guinean internationals Menzie Yere (on loan from Sheffield Eagles) and Jason Tali.

    The Supreme Court on 28 March 2019 declared unconstitutional and invalid forthwith Constitutional Amendment Laws passed by the National Parliament in 2014 removing the independent powers and functions of the Public Service Commission (PSC) relating to the appointment, suspension and revocation of appointment of Departmental Heads, Provincial Administrators and heads of Statutory Regulatory Authorities (RSA). The Court further declared invalid with immediate effect all the subsequent or consequential Acts of Parliament and Regulations (see below) passed by Parliament under these Constitutional Amendment Laws.

    RECOMMENDED: PNG IN 2017 | AN ANALYSIS OF PAPUA NEW GUINEA'S POLITICAL CONDITION AND TRENDS THROUGH TO 2025 by Bal Kama | 6 December 2017


    The basis of the declaration was that the National Parliament failed to comply with the mandatory procedures prescribed by Section 14 of the Constitution relating to enacting Constitutional Amendment Laws.

    In 2014 Dr Philip Kereme PhD., the Chairman of the PSC filed an application as a private citizen challenging the Constitutional validity of the Constitutional Amendment Laws passed by the Parliament in 2014. The opposing parties were: Peter O’Neill (Prime Minister), Ano Pala (Minister for Justice and Attorney General), Theo Zurenuoc (Speaker). These laws are:

    1. Constitutional Amendment (No. 38) (Appointment of Certain Offices) Law 2014; and 2. Organic Law on Provincial Governments and Local-level Governments (Amendment) (No 13) Law 2014.

    These Constitutional Amendment Laws removed the PSC’s respective powers and functions relating to the appointment, suspension and revocation of appointment of Departmental Heads, Provincial Administrators and the heads of Regulatory Statutory Authorities by repealing Sections 193 and 208B of the Constitution. To give effect to these laws the Parliament repealed the Public Services Management Act 1995 and enacted the Public Service Management Act 2014 (PSMA) (relating to dept. heads & Prov. Administrators), the Regulatory Statutory (Appointment to Certain Offices) (Amendment) Act 2013 (relating to heads of Regulatory Statutory Authority). The 2014 PSMA established the Ministerial Executive Appointment Committee (MEAC) which had powers to deal with the appointment, suspension and revocation of appointments of Departmental Heads and Provincial Administrators. The PSC’s independent involvement in these processes were removed and its powers and functions conferred on the MEAC. MEAC comprises five Ministers in which the Minister responsible for Public Service is the Chairman.

    The process in summary was that MEAC would determine all matters relating to the appointment, suspension and revocation of Departmental Heads and Provincial Administrators and recommend to the National Executive Council, of which they are members. In the absence of the PSC it is a political body prone to make decisions based on political interests and not necessarily on merit.

    As a result of the Court’s determination of the Constitutional Amendment Laws it declared that the related statutes which the Parliament had enacted to further implement these Constitutional Amendments are now declared unconstitutional and invalid forthwith. These Statutes are:

    1. Public Service Management Act 2014.
    2. Regulatory Statutory (Appointment to Certain Offices) (Amendment) Act 2013.
    3. Public Service (Management) (Employment of Departmental Heads) Regulations 2014.
    4. Public Service (Management) (Employment of Provincial Administrators) Regulations 2014.
    5. Regulatory Statutory (Appointment to Certain Offices) Regulations 2013.

    The legal effect of the Court’s decision is that the terms of Section 193 and 208B of the Constitution pre-2014 remains in force. The PSMA 1995 and the RSA 2004 remain in force. There is no vacuum and no gap in the law and therefore there should be no confusion.

    For the avoidance of doubt and perhaps even confusion, the Supreme Court declared that all or any actions taken under these laws now declared unconstitutional and invalid shall remain valid. In other words, any appointments, suspensions and revocations of appointments made remain valid. The Interveners were ordered to pay the Applicant’s costs of the proceeding.

    Dr Kereme did challenge the Constitutional validity of the Organic Law on Provincial Governments and Local-level Governments (District Development Authority) (Amendment) Law 2014 and the District Development Authority Act 2014 in his proceeding but the Court excluded these at the preliminary stage on 10 August 2017 on the basis that these did not relate to the PSC's powers and functions.

    Finally, this is a victory for good governance and the well-established systems and the laws and for the People of Papua New Guinea, in particular, the Public Service.
    I commend Dr Philip Kereme for taking the action in his capacity as a private citizen.

    Chief finance officer, Rajeev Sharma said that the benefit of compound interest can be seen when a NASFUND member does not withdraw funds for the long term. 

    Compound interest will further grow the member's balance if the member increases an additional amount from the normal mandated contributions of the member or employer contributions.

    In an example of a member who has contributed for 30 years.

    The illustration below shows the benefit of increasing one’s contribution through voluntary contributions of K50 and K150 with an assumed average return of interest of 5% for 30 years.

    A member who increases an additional contribution of K50 for the next 30 years will have a total additional balance of K40,866, out of which he would have contributed only K 18,000 and a balance of Kina 22,866 would come from interest. 

    However, if the NASFUND member increases an additional K150 for the next 30 years, the member will have K122,579 as his total balance.

    “This is the magic of compound interest”, he said. 


    “This will happen if the member does not touch the funds while still contributing and the savings will grow through the interest that is being credited by the FUND annually”. 

    NASFUND has paid K1.4 billion as crediting amount to it’s members in the last six years.

    3. Faxed or emailed copies of the 2019 Unitech Application form for re-admission will not be accepted.

    4. Application form is available on the PNG UNITECH website (http://www.unitech.ac.pg).  You can also request for an application from through the email address stated below (9).

    5. Application close on the 20th of April 2019. Any application forms received after the closing date will be rejected.

    6. Applicants are required to carefully read through the instructions and strictly comply to avoid outright rejection of their application forms.

    7. Applicants who are caught with forged/altered documents will be blocked and permanently disqualified from ever applying to any program at UNITECH in the future.

    8. The university will not accept two or more applications from an applicant.

    Refugees on Manus Island

    The Manus Island Immigrants Detention Centre created by the Australian Government is an immigration burden to PNG. In fact, PNG would be happy for Australia to whatever it wants with them. 

    The detention adds to social development issues on the island. The immigrant children born to local women faced an uncertain future.

    The big question going forward is what is going to happen to the immigrants on Manus Island? What about the children they are having with the local women on Manus?

    Will Australia take responsibility of the children who are born to the immigrants on Manus as Australian citizens? They cannot be left stateless. 

    The social implications on the lives of the refugees and their children are the results of the policy decision by the Australian government.

    The boats were diverted to Manus. The question is when is it going to arrive at their destination.

    Refocusing immigration on development 

    The recent immigration pattern is completely distorted. The temporary migrants and Manus Refugees do not have any bearing on the development of the country. Not long term benefits at all!

    PNG history showed us that immigration and development worked well in the past when the intention is for developing the country.

    Perhaps it is important PNG recognises immigration as a driver for development. Immigration patterns have been left unchecked for a long time. As a developing country, immigration must be for development.
